WHAT ABOUT PENSIONS?
In Mexico, every worker has a retirement pension and a housing pension
- These pensions are obtained through monthly contributions that are deducted from the worker’s salary to the Mexican Social Security Institute and INFONAVIT, who in turn remit it to an AFORE (Retirement Fund Administrator) and these in turn reinvest the resources to achieve secure returns.
- All companies in Mexico are required by law to deliver them to the IMSS and INFONAVIT, but the employee cannot access these resources except in the following cases:
1. Partial retirement due to unemployment or marriage.
2. Old age retirement at age 60.
3. Life pension at age 75.
WHAT ABOUT FOREIGNERS?
Mexican law does NOT provide for the case of those foreign workers who worked in Mexico, return definitively to their country of origin but do not fall under the assumptions foreseen in Mexican law.
- This could result in the foreigner losing all of these resources if he/she returns to his/her country of origin and never claims them, which generally are quite large sums of money.
- However, the foreigner CAN recover these resources, since they are his property, which is why at Martínez Estebanez y Asociados Abogados, S.C., we can assist you in obtaining them through a Special Lawsuit, emphasizing that it can be carried entirely from Mexico without the foreigner having to come to the country, once we recover the funds, they are sent by international transfer to the foreign bank of your choice.
