TERMS AND CONDITIONS

Based on Articles 15, 16 and other applicable provisions of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “LFPD”) and its Regulations, complementing the Privacy Policy we let you know the following terms and conditions thereof.

1.   RESPONSIBILITY OF COLLECTING YOUR DATA.

Martinez Estebanez Abogados y Asociados, S.C, addressed at Sierra de las Palomas No. 220, Bosques del Prado Sur, ZIP CODE 20170, in the city of Aguascalientes, Aguascalientes, Mexico is the entity responsible for collecting your personal information.

1.   MEANS TO OBTAIN YOUR PERSONAL DATA.

This entity can gather your personal information, for the purposes that are outlined further on, when office staff is placed in direct contact with you by email or by any other means necessary to achieve the purposes for which this Firm has been hired.

  • COLLECTED PERSONAL DATA.

The personal data that this Firm gathers include: full name, address, email address and fiscal data.

However, due to the services provided, additional information may be requested regarding the cases that this Firm has taken in your name and representation, and previously accepted by the client.

1.   PURPOSE OF PROCESSING PERSONAL DATA.

The personal data stated above will be used by the Responsible with the following purposes, in response to the legal relationship that has been consulted and/or hired:

  • Provide support, care and personalized advice for the cases that you submit to our study and consideration.
  • Provide legal services to properly solve the issues that you have entrusted to our professionals.
  • Develop contracts, letters, opinions or any other legal document to provide the services regarding the issues entrusted to this Firm.
  • Prepare bills and make collections.
  • Any other purpose necessary to provide the hired legal services.

Your personal data may be transferred and treated by third parties within our outside this country. In this sense, you information may be shared with companies, persons or legal experts that will provide professional services to complement our legal services, regarding the cases that you have hired this Firm to take. Similarly, data can be transferred in cases established in Article 37 of the LFPD.

1.   REQUEST TO EXERCISE YOUR “ARCO” RIGHTS (ACCESS, RECTIFICATION, CANCELATION OR OPPOSITION).

According to the provisions of the LFPD and it´s regulation, the Responsible entity will guarantee the privacy of the gathered personal information, and limit it´s use, storage and dissemination through the physical receipt or mail to fulfill the objectives established for the processing of personal data.

All your personal data is treated in accordance with the applicable legislation in this country. We inform you that you have at all times the right to access, modify, cancel or oppose the treatment we give to the personal data, and to revoke consent to the treatment thereof; these rights may be enforced by sending a request by e-mail before mentioning and including at least the following information: (i) the name and address or email through which we will respond to your request; (Ii) the documents proving your identity or, legal representation; (iii) a clear description of personal data which you wish to exercise any of the above rights on; and (iv) any other item or document that facilitates the location of personal data on the request. Your request will be answered within the time allowed by law via e-mail or the address you provided, based on Article 29 of the LFPD.

  • MODIFICATIONS TO THE PRIVACY POLICY.

This Privacy Policy may be changed at any time by the Responsible. Said changes or modifications will be made automatically on the website and you will be duly notified through the page www.martinezestebanez.com.mx.

Based on articles 15, 16, and other applicable articles of the Federal Law on Protection of Personal Data Held by Private Parties (hereinafter the “LFPD”) and its Regulations, as a complement to the Privacy Notice, you are informed the following terms and conditions thereof.

– IDENTITY AND ADDRESS OF THE DATA CONTROLLER:

– MEANS OF OBTAINING PERSONAL DATA.
For the purposes indicated below, the Controller may collect your personal data: when office personnel contact you directly, by email or by any other means necessary to carry out the purposes for which you have been hired.

– PERSONAL DATA COLLECTED.
The personal data we collect from you are: full name, address, email and tax information.

However, due to the services contracted with the Responsible, additional information could be requested regarding the specific cases and accepted by The Client.

– PURPOSES OF THE PROCESSING OF PERSONAL DATA.
The personal data mentioned in the previous section will be used by the Controller for the following purposes in response to the legal relationship that has been consulted and/or contracted:

Provide support, attention and personalized advice for the issues that you submit to our study and consideration.
Provide you with legal services for the adequate solution of the issues that you entrust to our professionals.
Prepare contracts, letters, opinions or other legal documents related to the advice and services of the matters entrusted to us.
Make payments and prepare invoices.
Any other necessary for the performance of the contracted service.

– TRANSFERS.
Your personal data may be transferred and processed inside and outside the country, by people other than this office. In this sense, your information may be shared with other companies or people that provide professional services, to complement the legal services that have been contracted, as well as in cases to contact experts related to the matters in which you are represented. Likewise, your data may be transferred in the cases established in article 37 of the LFPD.

Type of information that is collected, For Employees or candidates:

Name, sex, age, marital status, address, date of birth, country, nationality, profession, activity or business to which he or she was engaged, telephone numbers, family references, degree of studies, schooling, curp, rfc, same as are part of the job application or resume.

Purpose: The information will be used for everything related to the recruitment and hiring process, to carry out studies of labor results, development of activities, etc. related to the functions of the position that is intended to be performed; as well as to respond to the recruitment request of the applicants. It may be transferred to third parties, for the purpose of exchanging labor references, audits and any authority requirement.

Of Visitors to the facilities: Names, company or client data, which are registered in the visitor or client log.

Purpose: The information will be processed for statistical, security and surveillance purposes during the duration of your stay in the building, if any illegal activity is detected, or to demonstrate in disputes or judicial and/or administrative requirements, this information is not transferred outside from the country.

Sensitive data: The Law Firm Martinez Estebanez y Asociados, Abogados, does not collect sensitive data, the foregoing in accordance with article 3 section VI and article 9 second paragraph, of the Federal Law on Protection of Personal Data Held by Private Parties.

Validity of the Information:

Of employees or candidates: They will be destroyed no later than two months after the conclusion of the labor obligations or those that have been generated as a result of the recruitment process and that were not hired. In the case of active Employees, this information will be used for statistical data for the purposes of complying with third parties, to exchange labor references, audits and any authority requirement, this information is not transferred outside the country.

Visitors to the offices: They will be destroyed within a period of two months, counted from the time the log has been used or completed for purposes of complying with audit issues.

Confidentiality of information:

Martinez Estebanez y Asociados, Abogados, S.C. You may not sell or transfer data to any unauthorized person, except as expressly provided for the purpose of such information.

Protection of personal data: In order to prevent unauthorized access and disclosure, only the necessary data is kept according to its purpose, adequate measures are guaranteed to ensure this protection since the data is protected with security measures with access limited.

Opposition to the transfer of personal data: In the event that you oppose the transfer of your personal data, referred to in subparagraph a) above, you will have 5 calendar days, from when you become aware of this privacy notice, to express your opposition in writing or via email, directly to the page privacidad@martinezestebanez.com.mx and in the event that you do not do so, it will be understood that you are giving your consent to transfer your data.

By virtue of the legal relationships between the owner and the person in charge in which personal data is processed or handled, Martinez Estebanez y Asociados, Abogados, S.C., will NOT need consent for the processing of said personal data. Article 10 LFPDPPP.

Manifestation of Refusal for the processing of personal data and revocation of consent: The owner of the personal data may express his refusal for the processing of personal data or revoke consent in writing and by email directly to the page: privacidad@martinezestebanez.com.mx.

– REQUEST FOR THE EXERCISE OF ARCO RIGHTS (ACCESS, RECTIFICATION, CANCELLATION OR OPPOSITION).

In accordance with the provisions of the LFPD and its Regulations, the Responsible party guarantees the privacy of the information and limits its use, storage and dissemination through its due physical or electronic safeguard for the fulfillment of the objectives established for the processing of personal data.

All your personal data is treated in accordance with the applicable legislation in force in the country, therefore we inform you that you have the right at all times to access, rectify, cancel or oppose the treatment that we give to your personal data, as well as to revoke the consent granted for the treatment thereof; rights that you can assert by sending a request to the aforementioned email address, as well as indicating at least the following information: (i) full name and email address or address to notify you of the response to your request; (ii) the documents that prove your identity or, where appropriate, legal representation; (iii) a clear description of the personal data with respect to which you seek to exercise any of the aforementioned rights; and (iv) any other element or document that facilitates the location of the personal data that is the object of the request.
